Zoning Appeals Applications

  • Zoning Appeals Application Cover Page (PDF) - Complete the application cover page to submit with your application.
  • Use Variance Application (PDF) - This is an application to request a variance to allow a land use that is not typically permitted in a certain zoning district. In order to grant a Use Variance, the BZA shall determine that strict compliance with the terms of the Zoning Code will result in an unnecessary hardship to the applicant. The applicant must demonstrate such a hardship by clear and convincing evidence that all of the criteria in Section 150.120.10 (D)(2) of the Zoning Code are satisfied.
  • Variance Application (PDF) - This is an application to request a Variance from the regulation(s) in the Zoning Code as cited in a Zoning Administration Refusal letter. The BZA may authorize Variances only when the BZA has made findings of fact based upon the standards set out in Section 150.120.10 (D)(1) of the Zoning Code.
  • Conditional Use Application (PDF) - This is an application to request Conditional Use approval for a proposed use that may be permitted in a zoning district as a conditional use. The BZA shall review the particular facts and circumstances of each proposed use in terms of the criteria found in Section 150.535 of the Zoning Code.
  • Appeal Application (PDF) - This is an application to request a hearing to appeal a violation notice or decision made by the Zoning Administrator or Landmark Commission. Appeals to the BZA shall be filed within 30 days from the violation notice or decision.
